Terms of service
Last updated 17 October 2026
These terms govern your access to and use of Monitrx (the “Service”). Monitrx is provided by [Company legal name], registered at [Registered address] (“Monitrx”, “we”, “us”). By creating an account or using the Service, you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you have authority to bind it.
1. Your account
- You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account and must tell us promptly about any unauthorised use.
- You must be old enough to enter a binding contract in your jurisdiction, and at least 16 years old.
- We may suspend or close an account that violates these terms or creates a security, legal or operational risk.
2. Acceptable use
You agree not to use the Service to:
- monitor, probe or attack systems you do not own or have permission to test, or otherwise break the law;
- disrupt, overload or reverse engineer the Service, or attempt to access it other than through the interfaces we provide;
- send spam, malware or unlawful content through notification channels or status pages;
- infringe the rights of others or process data you are not permitted to process.
You are responsible for the targets you monitor and the content you publish. We may remove content or restrict access that breaches these terms.
3. Plans, fees and billing
- Paid plans, their limits and their prices are described on our pricing page. Limits are enforced by the Service.
- Fees are payable in advance and, unless stated otherwise, are non-refundable. We may change prices with reasonable notice; changes apply from your next billing period.
- We may suspend paid features if payment fails. You can cancel at any time, and the plan remains active until the end of the period you have paid for.
4. Availability and support
We work to keep the Service available and to run checks on schedule, but we do not guarantee uninterrupted or error-free operation. Any uptime or response-time targets, and any support commitments, apply only if set out in an order form or a separate written agreement. Planned maintenance and factors outside our control may affect availability.
5. Monitoring data and disclaimer
The Service reports what our probes observe from their networks. A check result is not a guarantee about your systems or a substitute for your own monitoring and incident response. You are responsible for acting on alerts and for the decisions you make based on the Service.
6. Intellectual property
We and our licensors own the Service and everything in it. You keep ownership of the content and data you submit, and you grant us a limited licence to host and process it so we can provide the Service. These terms do not transfer any of your rights to us, or ours to you.
7. Third-party services
The Service can send data to third-party services you configure, such as chat tools or webhooks. Those services are governed by their own terms, and we are not responsible for them.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the same extent, we are not liable for indirect or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability arising out of or relating to the Service is limited to the fees you paid for it in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, or wilful misconduct.
9. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for material breach of these terms, for non-payment, or where required by law. On termination we will make your data available for export for a short period where practical, and then delete it in line with our Privacy policy.
10. Changes to these terms
We may update these terms from time to time. If a change is material we will give reasonable notice, and continued use of the Service after the change takes effect means you accept the updated terms.
11. Governing law and contact
These terms are governed by the laws of [Governing jurisdiction], and its courts have exclusive jurisdiction, without affecting any mandatory consumer protections you may have. Questions about these terms can be sent to legal@monitrx.io.
